U.S. Supreme Court stays OSHA’s emergency temporary standard

Today, the U.S. Supreme Court stayed the Occupational Safety and Health Administration’s (OSHA) emergency temporary standard (ETS) that mandated employers with at least 100 employees follow several requirements, including requiring employees who are not fully vaccinated to test weekly for COVID 19 and wear face coverings over their noses and mouths at all times while indoors in the workplace. 

Due to this ruling, Publix will not move forward with implementing the ETS, including the previously required testing of associates who are not fully vaccinated. Effective immediately, face coverings are to be worn completely covering an associate’s nose and mouth while in our

  • stores 
  • office locations where social distancing of 6 feet or more cannot be maintained, (such as common areas like hallways, the cafeteria line, restrooms, open spaces like workbenches) and
  • industrial operations locations, unless associates can maintain a distance of 6 feet or more from one another (such as in a break room or in a selector role).
